Terms of Service
Last updated: October 4, 2026
These terms explain how you may use GigMetrics. GigMetrics is operated by Ken Lewis, LLC (“we”, “us”). By creating an account or using GigMetrics, you agree to these terms. Please also read our Privacy Policy.
1. Eligibility and your account
GigMetrics is operated from the United States and is currently intended primarily for users in the United States.
You must be at least 18 years old to use GigMetrics. You agree to give accurate sign-up information, keep your password and any Quick Capture shortcut link private, and tell us at support@gigmetrics.app if you think someone else has accessed your account. You are responsible for activity on your account.
2. What GigMetrics does
GigMetrics helps gig drivers analyze delivery offers, record which offers they took or passed, track trips, earnings, mileage, fuel and vehicle costs, compare an offer's predicted result with what actually happened, and view AI-assisted insights about their own records.
3. You stay in charge of your decisions
GigMetrics does not accept or decline offers for you and does not connect to your gig platform account. Offer scores, Take/Borderline/Pass recommendations, Coach, Insights and Strategy are information to help you think — not instructions. You are responsible for your own work, driving, safety and business decisions.
We do not guarantee any earnings, profit, availability of work or financial result. GigMetrics is not financial, tax, accounting or legal advice.
4. Accuracy of results
Results depend on the information you enter, what can be read from your screenshots, what the gig platform displayed, and your history in GigMetrics. Any of these can be incomplete or wrong, so results can be too. Please check important numbers yourself.
5. AI-assisted features
Some features use AI to read screenshots, turn voice notes into entries, and write insights. AI output can be inaccurate, incomplete or unexpected, and you should review it before relying on it. This does not excuse errors in GigMetrics' own calculations; if you find one, please tell us.
6. Gig platforms
GigMetrics is independent. It is not affiliated with, endorsed by or sponsored by Walmart, Spark Driver or any other gig platform. Platform names are used only to describe the work you record.
7. Free plan
GigMetrics offers a Free plan with a limited set of features and limited history. We may change what the Free plan includes going forward.
8. GigMetrics Pro subscription
GigMetrics Pro costs $9.99 per month, plus any applicable tax shown at checkout. It renews automatically each month and is charged to your payment method until you cancel. You can cancel online at any time in Settings → Manage subscription.
Purchases are processed through Stripe Managed Payments. For these purchases, Stripe (through its Link service) is the merchant of record: it processes the payment, calculates and collects applicable sales tax or VAT, and handles fraud prevention, payment disputes and transaction-level support. Its own terms apply to the purchase. We provide the GigMetrics service itself.
9. Cancelling Pro
You can cancel any time from Settings → Manage subscription. Cancellation takes effect at the end of your current paid period: Pro stays available through the paid-through date, and then your account returns to the Free plan. Ending Pro does not delete your account or history, but Free-plan limits on features and visible history then apply.
10. Failed payments
If a monthly renewal payment fails, Stripe retries it automatically. Pro stays available only while Stripe still treats your subscription as active during that retry period. If Stripe cannot collect the payment and ends the subscription or marks it unpaid, your account returns to the Free plan. GigMetrics does not add any extra grace period of its own. You can update your payment method in Settings → Manage subscription.
11. Refunds
Payments are generally non-refundable once a billing period begins, except where required by law or where we approve a refund in appropriate circumstances. To ask about a refund, contact support@gigmetrics.app.
Because Pro purchases are made through Stripe Managed Payments, they are also subject to the refund rules Stripe and Link apply as merchant of record, and Stripe may issue refunds as those rules permit.
12. Acceptable use
Please do not: access other people's accounts or data; try to get around plan limits, AI usage limits or security controls; interfere with or overload the service; reverse-engineer or resell it; or use it for anything unlawful.
13. Ownership
We own the GigMetrics software, design, name and content. You keep ownership of the data and screenshots you provide. You give us permission to store and process them only as needed to run GigMetrics for you, as described in our Privacy Policy.
14. Changes and availability
We may add, change or remove features and plans. GigMetrics may sometimes be unavailable for maintenance or because of outages, and we do not promise uninterrupted service.
15. Ending your account
You can delete your account at any time in Settings. We may suspend or close accounts that break these terms or put the service or other users at risk.
16. Disclaimers and limits of liability
GigMetrics is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties, and we are not liable for indirect or consequential losses, such as lost earnings from offers you took or passed. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for GigMetrics in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
17. Governing law
These terms are governed by the laws of the State of Maine, USA, without regard to conflict-of-law rules.
18. Changes to these terms and contact
We may update these terms. We will change the “Last updated” date above and, for important changes, tell you in the app. Contact us at support@gigmetrics.app.
